Starting next summer (July 1, 2026), Virginia will allow some records to be sealed. More specifically, Virginia residents with certain misdemeanor and felony convictions will be able to petition to have their records sealed, meaning those convictions won’t appear on background checks.
Key eligibility requirements include:
- People With Felonies: No new convictions for 10 years
- People With Misdemeanors: No new convictions for 7 years
- Ineligible:
- Class 1 or 2 felonies (typically violent crimes or offenses carrying life sentences)
- Anyone convicted of a Class 3 or 4 felony within the past 20 years
